Weekend Family Workshop Agreement

2. ASSUMPTION OF RISKS AND RELEASE. I acknowledge that participation in the program carries inherent risks of injury, illness, and emotional distress for myself or my child(ren); I am aware that the program involves strenuous physical activity and personal contact, including participation in and/or witnessing of simulated assault scenarios which could be physically harmful and/or emotionally stressful, as well as close proximity to others which carries the risk of illness or communicable disease, and I voluntarily assume any and all risks of injury, illness, emotional distress, and loss for myself and my child(ren) through participation in or as a result of the program. I understand that participation in the program cannot guarantee safety in a real-life situation. Additionally, I understand that participation in the program creates a risk of myself or my child(ren) causing physical injury, emotional distress, illness, or other loss to another person or property, including through use of these techniques, whether inappropriate or not, and I voluntarily assume these risks.

I hereby release and hold harmless Kidpower for any injury (including emotional distress), illness, loss, or damage (to property or otherwise) sustained in connection with participation in the program, the use of self-defense techniques taught in the program, and my (or my child(ren)’s) use of Kidpower facilities, whether caused by the fault of myself, my child(ren), my family, Kidpower, or other third parties, including any injury, illness, loss, or damage that results from the negligence of Kidpower. I understand that if my child(ren) or I are injured, become ill, or property is damaged while participating in the program, or as a result of the program, neither my child(ren) nor I have a right to make a claim or file a lawsuit against Kidpower, inter alia in accordance with C.R.S. 13-22-107.

3. INDEMNIFICATION.I agree to defend, indemnify, and hold harmless Kidpower against all demands, claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my child(ren)’s participation in the program, use of Kidpower techniques, or presence upon the facilities of Kidpower, including any such claims or demands from third parties. I accept full responsibility for the actions of my child(ren) and myself. This full agreement is binding upon my heirs, legal representatives, and successors.

4. REPORTING. I understand that if my child(ren) or I disclose a situation which involves child abuse that is not already handled (at Kidpower’s discretion), Kidpower may report this to appropriate authorities.

5. REQUIRED DISCLOSURES. I verify that the person or persons listed in Section 1—my child/children, as participant(s) in the program—is/are not, to my knowledge, pregnant, nor do they have an emotional or physical condition (e.g. an injury, disability, illness, pregnancy, or other status) which would endanger them or anyone else through participation in the program. I agree to disclose to Kidpower each and every current or recent physical or emotional condition which might affect or be affected by that person’s (or those persons’) participation in the program.

6. ENFORCEABILITY AND OTHER TERMS. The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision, and such invalid or unenforceable provision shall be deemed not to be a part of this agreement. I agree that I am under no pressure or duress to sign this agreement, and I have been given a reasonable opportunity to review it before signing. I acknowledge that I am free to have my own legal counsel review this agreement if I so desire.

1. This agreement is between the undersigned and Kidpower of Colorado, Inc., Kidpower International, and affiliated employees, staff, volunteers, board members, and directors (hereinafter referred to collectively as “Kidpower”).

3. I authorize Kidpower to record my child(ren) and me during the graduation portion of the workshop only for the following purposes: (1) use by class participants and (2) in-house (Kidpower) training.

4. I hereby release Kidpower from any and all liability of any nature which may result from Kidpower’s use of video in which my child(ren) and/or I appear.

5. I agree to defend, indemnify, and hold Kidpower free and harmless from any demands, claims, or liability of any nature or kind resulting from my child(ren) and/or my appearance in the video. This agreement is binding upon my heirs, legal representatives, and successors.

1. This agreement is between the undersigned and Kidpower of Colorado, Inc., Kidpower International, and affiliated employees, staff, volunteers, board members, and directors (hereinafter referred to collectively as “Kidpower”).

3. I understand that the names of my children and myself will not be displayed in connection with these materials.

4. I hereby release Kidpower from any and all liability of any nature which may result from Kidpower’s use of photographs in which my child(ren) and/or I appear.

5. I agree to defend, indemnify, and hold Kidpower free and harmless from any demands, claims, or liability of any nature or kind resulting from my child(ren) or my appearance in the photographs. This agreement is binding upon my heirs, legal representatives, and successors.
